These Terms and Conditions apply to all gardening and handyman services provided by AJB Handy Services (“we”, “us”, “our”) to the customer (“you”, “your”).

By accepting a quotation or allowing work to commence, you agree to be bound by these Terms.

1. Our Legal Obligations

We will carry out all work:

With reasonable care and skill in accordance with the Consumer Rights Act 2015
In compliance with relevant health and safety legislation
Within a reasonable time (unless a timeframe is agreed in writing)

Nothing in these Terms limits your statutory rights.

2. Quotations and Estimates

2.1 Written quotations are valid for 30 days unless stated otherwise.
2.2 Estimates are approximate and may change if the scope of work differs from what was originally discussed.
2.3 We will inform you before carrying out any additional chargeable work.
2.4 Prices will state whether VAT applies.

3. Booking and Payment

3.1 A deposit may be required for larger projects.
3.2 Payment is due upon completion unless otherwise agreed in writing.
3.3 For projects lasting more than one day, staged payments may be agreed.
3.4 We reserve the right to charge statutory interest and compensation on overdue invoices in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 (for business customers).
3.5 We may suspend work if payment is overdue.

4. Cancellation Rights (Domestic Customers)

If you are a consumer and the contract is agreed at your home or online, you may have cancellation rights under the Consumer Contracts Regulations 2013.

You have 14 days to cancel from the date the contract is agreed.
If you request work to begin within the 14-day period, you may be required to pay for work carried out up to the date of cancellation.
Once services are fully completed, cancellation rights no longer apply.

Business customers do not have these cancellation rights.

5. Customer Responsibilities

You agree to:

Provide safe and clear access to the work area
Ensure pets and children are kept away from work areas
Inform us of any known hazards (e.g. underground cables, asbestos, unstable structures)
Obtain any necessary permissions (e.g. landlord consent, planning permission)

We are not liable for delays or additional costs caused by restricted access or undisclosed hazards.

6. Materials and Waste

6.1 Materials remain our property until paid for in full.
6.2 Garden waste removal is included only if stated in the quotation and may be subject to additional charges.
6.3 We will dispose of waste in accordance with UK environmental regulations where agreed.

7. Weather and External Factors

Gardening and external work is weather dependent. We reserve the right to reschedule due to:

Heavy rain
High winds
Frost or extreme temperatures
Other unsafe conditions

We will rearrange at the earliest reasonable opportunity.

8. Liability and Insurance

8.1 We hold public liability insurance appropriate for our work.
8.2 We are not liable for:

Pre-existing damage
Plant failure due to disease, pests, or extreme weather
Natural movement or minor cracking in landscaping materials
Damage caused by hidden defects or undisclosed hazards

8.3 Our total liability is limited to the value of the services supplied, except where liability cannot be excluded by law (including death or personal injury caused by negligence).

9. Guarantee

We guarantee workmanship for 3 months from completion.

This does not cover:

Fair wear and tear
Misuse or neglect
Damage caused by third parties
Failure to follow maintenance advice

10. Complaints

If you are dissatisfied, please notify us within 7 days of completion. We will inspect the issue and aim to resolve it promptly and fairly.

11. Force Majeure

We are not responsible for delays caused by events beyond our reasonable control, including severe weather, supplier shortages, illness, or government restrictions.

12. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.

By accepting our quotation or allowing work to commence, you confirm that you agree to these Terms and Conditions.
